Justice Manindra Mohan Shrivastava appointed as Acting Chief Justice of Rajasthan High Court

The President of India in the exercise of the power conferred by Article 223 appoints the acting judges of the High Courts.

Justice Manindra Mohan Shrivastava has been appointed as the Acting Chief Justice of Rajasthan High Court.

Shri Shrivastava who is the seniormost Judge of the Rajasthan High Court will perform the duties of the office of Chief Justice of Rajasthan High Court, with effect from 07.03.2022, read a press release by the Department of Justice (Appointments Division), Ministry of Law & Justice.

What is Article 223 of the Indian Constitution?

Article 223 of the Indian constitution talks about the appointment of acting Chief Justice. It provides that when the office of Chief Justice of High Court is vacant or when any such Chief Justice is, by reason of absence or otherwise, unable to perform the duties of his office, the duties of the office shall be performed by such one of the other Judges of the Court as the President may appoint for the purposes.

Though the President formalizes the process, it is actually the Supreme Court Collegium that recommends the names to Union Government which after due scrutiny forwards it to the President.
